Plaintiffs File Joint Xarelto Lawsuit Alleging Anticoagulant Caused Death Of Family Members
February 10, 2016 – – BloodThinnerHelp.com reports on another lawsuit which has been filed against Bayer AG and Janssen Pharmaceuticals (a division of Johnson & Johnson corporation), the manufacturers of blood thinning drug Xarelto. The claim was filed by a group of 10 people who reside in several different states but all synonymously allege that anticoagulant Xarelto has caused the death of their family members because of its dangerous bleeding side effects.
The plaintiff group is made up of multiple family members who represent their deceased loved ones. These loved ones have passed away due to common health complications while taking Xarelto. Family members have now filed a wrongful death lawsuit under case number 15-L-670 in a St. Clair County Circuit Court. The suit was filed on November 20th of 2015.
Details found within the court documents further explain that plaintiffs claim defendants actively researched, marketed, and designed their new-generation blood thinner (Xarelto), yet knowingly chose to fraudulently misrepresent it as a safe and effective treatment for patients who had recently undergone knee and hip replacements, or those suffering from atrial fibrillation, (a common heart condition).
The lawsuit additionally alleges that through these misleading marketing tactics and advertisements, many of which use celebrity endorsements and discuss the many benefits of the drug, Bayer and Janssen have falsely presented the drug and neglected to adequately inform the public of its potentially dangerous side effects.
Plaintiffs state that the U.S. Food and Drug Administration reached out to Xarelto manufacturers in June of 2013 via a letter which informed them that their marketing campaign claims were misleading. They allege that despite this, Bayer and Janssen continued to advertise their blood thinner in this fashion.
Together, these plaintiffs now charge the defendants with nine counts of wrongdoing, ranging from fraud to wrongful death. They are requesting a minimum of $50,000 compensation for each family member who has passed away, in order to cover mounting medical bills, funeral expenses, legal fees, and general pain and suffering.
Across the United States, Xarelto lawsuits number over 3,000 cases. Over 2,800 of these cases have been consolidated in a Louisiana federal court and more than 550 other cases have been consolidated to form a mass tort group in Philadelphia, Pennsylvania.
