Xarelto Lawsuit Plaintiffs Observe Progression Of Bellwether Trial Preparations In Eastern Louisiana MDL 2592
March 22, 2016 – – BloodThinnerHelp.com reports on further bellwether trial preparations for lawsuits selected from over 2,800 federally-filed Xarelto complaints which have been transferred and consolidated by the U.S. JPML to form MDL number 2592. The consolidated lawsuits are joined by another group of over 600 complaints which have formed a mass tort program in Philadelphia, Pennsylvania. All lawsuit plaintiffs involved name the same defendants, Xarelto manufacturers Bayer AG and Johnson & Johnson subsidiary Janssen Pharmaceuticals. The lawsuit plaintiffs also share striking allegations that Xarelto use puts patients at heightened risk for sudden and dangerous bleeding episodes, which, in some cases, have proven fatal.
Cases involved in MDL 2592 are centralized under a single court in Eastern Louisiana, where they are being overseen by the Honorable Judge Eldon Fallon. Most recently, according to a court order provided by the Judge on December 17th, 2015, the process of selecting 40 lawsuits to make up a bellwether trial pool from all cases within the MDL has taken place.
The Judge’s order asked both plaintiffs and defendants to select 10 representative cases for the bellwether pool by January 11, 2016. He also noted that by January 15th of 2016, the court would add 20 more cases (selected at random) to join the others. This would make up a bellwether trial pool of 40 cases from which 4 representative cases would be chosen to be heard at bellwether trials.
Today, Xarelto bleeding lawsuits continue to grow in number on a regular basis. Together, the MDL cases and the mass tort program make up more than 3,400 lawsuits, and many involved believe that these numbers will only continue to grow as bellwether trial dates are currently scheduled for February of 2017.
