PSC Works To Assist Those Who Have Filed A Zofran Lawsuit
April 01, 2016 – – Zofranlegal.com has reported that the Plaintiffs’ Steering Committee (PSC) has been working hard to assist each of the plaintiffs who have filed a Zofran birth defect lawsuit.
The committee was created by the honorable Judge F. Dennis Saylor on December 17th, 2015, when he issued MDL 2657 Order No. 8. There are fourteen lawyers assigned to the PSC. Their assigned duties include initiating, coordinating, and conducting pretrial discovery, proposing a timeline to the Court for the commencement, execution, and completion of discovery, to call meetings for the counsel of all plaintiffs, and to negotiate settlements on behalf of plaintiffs. Currently, the PSC is working on the pretrial discovery.
There are more than 230 lawsuits currently filed in MDL 2657, each one alleging that the anti-emetic drug Zofran caused a birth defect in an unborn child. The drug was first released in 1991 and according to the FDA, it was intended for the treatment of nausea and vomiting in patients who have undergone treatments involving anesthesia, radiation, and chemotherapy. However, millions of expectant mothers have also been prescribed the drug to treat a condition called morning sickness.
GlaxoSmithKline, the manufacturers of Zofran, advertised the drug as a “safe” and “effective” treatment for pregnant women and their babies despite the lack of FDA approval. Both the plaintiffs and the U.S. Department of Justice have called this promotion “unlawful”. The DOJ filed its own lawsuit against GSK, which ended when the company agreed to a settlement which included fines of nearly three billion dollars.
