Zofran Lawsuit Plaintiff Claims Child Was Born With Hypoplastic Right Heart Syndrome Because Of Fetal Exposure To Drug
April 05, 2016 – – ZofranLegal.com reports on a Zofran birth defect related lawsuit which has been filed against corporate giant GlaxoSmithKline, who manufactures the drug. The complaint was filed by an Illinois mother who alleges that fetal exposure to Zofran through her body while pregnant caused her unborn son to develop a serious heart defect. The woman claims that defendant GSK’s, “conduct has caused devastating, irreversible, and life-long consequences and suffering to newborns and their families.” With this statement, she is speaking for the hundreds of other parents who join her in filing similar Zofran lawsuits and making similar claims.
Details of this particular lawsuit show that the mother was prescribed Zofran by her doctor while pregnant, as many women are. She took the anti-nausea drug to help battle morning sickness during her first trimester. The first trimester is a time when pregnant mothers frequently suffer from episodes of nausea. Unfortunately, it is also a time when the fetus completes much of its initial heart, limb, and mouth tissue development. The plaintiff claims that after using Zofran, her pregnancy progressed normally until she gave birth to a son in 2012 who was immediately diagnosed with hypoplastic right heart syndrome.
Hypoplastic right heart syndrome is a congenital birth defect that is caused when the right side of the heart develops in a malformed way and is unable to correctly pump blood. This can significantly impair blood flow to the lungs, and often causes babies born with this condition to appear bluish in color on their lips, fingernails, or other parts of the body.
The plaintiff claims that doctors told her that her infant son would require a heart transplant surgery, which was considered a high-risk procedure due to the infant’s fragile body. The woman’s son successfully underwent the surgery, but the family continues to experience pain, suffering, and significant medical bills. She indicates that her son continues to require medical care today and is therefore requesting damages to help cover these mounting costs.
In a very controversial move, GlaxoSmithKline has marketed Zofran as a safe and effective treatment for mornings sickness despite the fact that the drug has never been FDA-approved for this use or tested for safety on pregnant women and their unborn children. Because of this “off-label” marketing, Zofran is frequently prescribed “off-label” to pregnant women from across the country.
