Fourth Circuit Affirms Verdict In Transvaginal Mesh Lawsuit

April 06, 2016 – – TheProductLawyers.com report on a Bloomberg article indicating that a federal appeals court affirmed the decision to award a plaintiff $2 million in a lawsuit (No.15-1102) against the transvaginal mesh manufacturer C.R. Bard. According to the article, the court upheld the trial judge’s decision to disallow information that the company complied with the FDA’s regulations for the device to be presented in court. As a result, the plaintiff, a Georgia woman, won the case and was awarded a $2 million settlement.

The plaintiff alleged that she had undergone several surgeries to remove the mesh after she claims the device caused her to suffer pain, bleeding and bladder spasms. In addition, lawyers representing the woman claimed that the company ignored warnings about the device.

Transvaginal mesh is currently manufactured by several companies including C.R. Bard, Boston Scientific, Johnson & Johnson, Coloplast Corp and Cook Medical. Most devices are usually made from non-absorbable synthetic propylene.

The device was approved by the FDA first in 1996 for use in procedures for stress urinary incontinence. It was approved again in 2001 to treat pelvic organ prolapse. Since then, thousands of women have claimed that the device caused adverse side effects that they would have considered more carefully had they felt they were adequately warned. Some of the side effects that plaintiffs have alleged include bleeding, infection, organ perforation, vaginal scarring, vaginal shrinking, mesh erosion through the vagina, inability to engage in sexual intercourse, neuro-muscular problems and recurrent incontinence or prolapse.

Cases concerning transvaginal mesh are expected to continue accumulating.
