Johnson & Johnson Attempt To Avoid $13.5 Million In Mesh Lawsuit
April 06, 2016 – – TheProductLawyers.com reports on a recent Philadelphia jury decision to award a woman $3.5 million, to be paid by Johnson & Johnson, after she allegedly suffered serious side effects from a pelvic mesh implant she received. The Johnson & Johnson unit, Ethicon, then filed a motion claiming the the $3.5 million awarded to the plaintiff was not supported by evidence of medical expenses.
The plaintiff filed the suit under case number 130603470 in June 2013 and alleged that the transvaginal tape used by Ethicon had interfered with her ability to engage in sexual intercourse and caused her constant pain. The jury passed down the verdict on February 10, 2016. Hers is the second case in Pennsylvania involving an Ethicon pelvic mesh device to go before a jury, according to Lexis Legal News.
Transvaginal mesh was approved by the FDA beginning in 1996. It was first approved for stress urinary incontinence and then later in 2002 for pelvic organ prolapse. The FDA warned of possible negative side effects in 2008 and again in 2011 and has since received 3,784 reports of serious injury, death or malfunction of the device. Some reports allege that individuals have suffered adverse side effects and have indicated problems including pain, infection, urinary problems,dyspareunia, organ perforation, bleeding. Recurring prolapse or incontinence, vaginal scarring or shrinkage, neuro-muscular problems, and emotional problems were also noted.
