Canadian Plaintiff Files Class-Action IVC Filter Lawsuit Requesting $200 Million In Compensation

April 07, 2016 – – TheProductLawyers.com reports on the details of a class-action lawsuit which was launched in Canada against Cook Medical, the U.S. manufacturer of IVC filters. IVC filters are medical devices which are implanted into patients who are unable to take blood-thinning drugs. The devices work as filters to prevent potential blood clots from traveling from the lower body to the heart and lungs, where they could become fatal. The devices are intended to be removed from the body after blood clot risks subside for each patient.

The plaintiffs currently filing suit against Cook Medical allege that their IVC filter devices are breaking apart when implanted inside of a patient’s body, and then become embedded and trapped there, potentially causing additional damage and pain to the body.

One plaintiff explains that she had a Cook Medical IVC filter implanted in her in August of 2013. It was intended to prevent an embolism due to a blood clot that had formed in her legs. Physicians were looking to block the blood clot from traveling to her lungs and heart. They inserted the IVC filter into her inferior vena cava. This is the largest vein in the human body. She notes, however, when the blood clot risk had subsided and she went to have the device removed just a few months later in October, doctors stated that the surgery was too risky and they were unable to proceed.

A following PET scan, the patient claims, showed that the IVC filter had fractured, and one of the legs of the device was actually piercing her internal jugular vein, while the other pieces of the device had become lodged in her small intestines. Because it was far too risky to remove pieces lodged in these areas with surgery, the plaintiff notes that she has to keep them inside of her, and also, therefore, remain on blood thinners for the duration of her life. She says that she is worried that the IVC filter pieces are like “ticking time bomb(s)” inside of her body. In an interview with CTV News, she noted that she suffers with fear that, “…someday I may move just the wrong way, or it may just fail on its own, which is what is happening, and the (device’s) leg will break and the filter will travel to my heart and kill me.”

The plaintiff states that she and her husband have since filed a $200-million class-action lawsuit against Cook Medical and allege that she had never been warned of such dangerous possible risks when deciding to use the device.
