Negligence Claimed By Invokana Lawsuit Plaintiffs

May 15, 2016 – – TheProductLawyers.com reports on Invokana and lawsuits filed against Janssen Pharmaceuticals, a subsidiary of Johnson and Johnson, linking a number of health issues such as heart attack, stroke, and kidney failure, to the new-generation, type-2 diabetes drug. Invokana was released to the market in 2013. Although it is one of a number of SGLT2 drugs approved by the U.S. Food and Drug Administration (FDA), Invokana is the one that has become the focus of lawsuits and extensive discussions by patients and medical professionals.

Invokana’s primary purpose is to maintain blood sugar (glucose) levels in type-­2 diabetes patients by preventing the kidneys from absorbing extra sugar and instead disposing of it out of the body via urination. Invokana relies heavily on the kidneys, and thus places an extra burden on the organs. Since diabetes patients are generally predisposed to kidney problems without medication, anyone with pre-existing conditions should be acutely aware of Invokana’s potential impacts on the kidneys.

One particular lawsuit, filed in December 2015 in an Alabama District Court, alleges that the plaintiff used Invokana for a brief period of time and claims she developed diabetic ketoacidosis. It is a very serious medical condition that could cause diabetic coma or death since it causes the blood to become overwhelmed with toxic acid.

The plaintiff further claims in her lawsuit that Janssen Pharmaceuticals was negligent in not fully making the public and the medical professionals aware of the potential risks of taking Invokana, as well as not investigating the potential side effects before releasing the drug on the market. Additionally, the lawsuit claims Invokana was promoted “off label” where a drug is used to treat something else that was not approved by the FDA. In this case, Invokana was promoted “off label” to treat type-1 diabetes, which was why the plaintiff was using the drug.
