Several Xarelto Lawsuit Plaintiffs Claim Drug Advertisements Are Misleading
May 23, 2016 – – TheProductLawyers.com reports on the U.S. Food and Drug Administration’s (FDA) issuance of two black box warnings in relation to Xarelto, a new-generation blood thinner drug manufactured by Janssen Pharmaceuticals, a subdivision of the Johnson and Johnson Corporation, and Bayer AG. Black box warnings are the harshest type of warning issued before a product is ordered to be removed from the market completely.
Numerous lawsuits have been filed in federal courtrooms across the United States alleging the drug has caused severe, and sometimes fatal, uncontrollable bleeding in patients. There have been over 2,800 cases consolidated by the U.S. Judicial Panel on Multidistrict Litigation (JPMDL) based upon the similar allegations about the drug and that all of the cases are against the same defendants. The multidistrict litigation (MDL) is being overseen by Judge Eldon Fallon in Louisiana and filed under MDL number 2592. More cases are expected to be added to the MDL as time goes on.
An additional 550 lawsuits have been consolidated in Philadelphia, PA in a mass tort program.
The makers of Xarelto have used a public relations campaign to promote the benefits of the drug in TV commercials using various celebrities such as golf great Arnold Palmer, NBA legend Chris Bosh, NASCAR star Brian Vickers, and Saturday Night Live persona Kevin Nealon. These celebrity spokespersons talk about their use of Xarelto and how it has helped them keep various medical conditions in check, but they do not address the many concerns and dangerous risks that have come to light since the drug was released on the market.
The plaintiffs in the many cases filed, however, have a very different perspective of the drug than that being expressed in the commercials. A good number of the plaintiffs suing the makers of Xarelto allege that the use of the drug places patients at risk of severe internal bleeding, which has been fatal in many cases.
