Cook Medical Requests More Time For Preparation In Settlement Negotiations For IVC Filter Lawsuit Filings
June 17, 2016 – – TheProductLawyers.com reports on a request made by Cook Medical in the proceedings for IVC filter lawsuit settlements. According to reports, the company recently asked that they be given more time to prepare for settlements after the original settlement conference was scheduled for February. The conference was then pushed back to late March until recently when the company requested an additional 60 days to prepare, claiming that counsel needed time to investigate the lawsuits that are pending in the MDL. Currently, Cook is facing 250 cases in the Southern District of Indiana claiming that they failed to inform patients about the inherent risks of using the IVC filters.
Cook Medical is not the only company facing lawsuits over IVC filters. C.R. Bard has also been met with hundreds of their own that make similar claims. A bellwether program has also been set up for the cases against them and the cases have been centralized in the District of Arizona. Bellwether selections for those cases are not expected to be chosen until 2017.
The litigation focuses on the use of the companies’ IVC filters. The cage-like devices are used to catch blood clots before they can reach the lungs and are used in patients at risk of pulmonary embolism. Patients have alleged, however, that the devices can break apart while in use and migrate to other parts of the body causing perforation and blockages. These cases further claim that the companies were aware of the defects of the device and did not attempt to remedy the problem.
