Muskogee Resident Files E-Cig Explosion Lawsuit Case, After E-Cigarette Explodes In Mouth
June 17, 2016 – – Marc Freund of LipsigLawyers.com provided commentary following a recent development in Oklahoma where a local man was afflicted with injuries due to an e-cigarette exploding in his mouth during use. Freund echoes his support to the Muskogee man and claims that “Warnings about these products are few and far between. In our experience, even retailers aren’t advising customers about the dangers of e-cigarettes.”
As detailed in a local report from Fox23.com, the plaintiff claims that the retailer who sold him the e-cigarette did not provide any warning of potential explosions. Shortly after purchasing the e-cig, the victim was using the device as it exploded causing him permanent injuries including visual impairment and facial burns. The victim has since filed a lawsuit claiming that the retailer was negligent, and is seeking financial compensation for damages.
Surprisingly, e-cigarette explosions have occurred an estimated 196 times since August of 2009 as reported by TheProductLawyers.com, and the frequency of cases is on the rise. The Federal Emergency Management Agency (FEMA) concluded that most e-cig explosions were caused by an overload of voltage while the lithium-ion battery was charging. In several cases, the overload occurred when plugged into a computer USB port, or a car outlet.
In recent weeks, there have been several similar cases. For example, on June 4th, a Tustin Man was taken to a local hospital after sustaining severe burns from his e-cigarette exploding during use. As e-cigarettes continue to grow in popularity, the frequency of explosions and resulting injuries are also likely to continue to increase.
