West Virginia Man Killed After Ditch Cave-In, Prompts Response From Construction Accident Lawyer
June 19, 2016 – – LipsigLawyers.com’s Thomas Moverman comments on a recent development in West Virginia that claimed the life of one construction worker on June 13th. Moverman sends his condolences to the family of the fallen victim and hopes that this can serve as yet another example to federal regulators for the need to create additional safety rules and regulations for the U.S. construction industry. He also notes that the number of construction accidents has increased greatly and that no signs point to a change in that trend.
According to a local report from the Marietta Times, a West Virginia worker was killed while installing a water treatment system in Preston County. The northern West Virginia native, a 38-year-old worker from Strange Creek was pronounced dead following a ditch caving in burying the man. Furthermore, the project he was working on was a former Decondor Coal site that was part of bond reclamation project commissioned by the DEP’s Office of Special Reclamation.
The Occupational Safety & Health Administration which is a federally mandated agency tasked with ensuring the safety and health of over 130 million workers is vastly underfunded. The agency only has 2,200 inspectors, who are each responsible for the lives of over 59,000 workers. The Bureau of Labor Statistics (BLS) indicated that 4,821 workers were killed while on the job in 2014. Of those fatalities, the construction industry claimed the lives of 899 workers and accounted for over 20 percent of all work-related fatalities in 2014.
