IVC Filter Lawsuit Case Filed By Canadian Plaintiffs Against Cook Medical, Alleging Devices In Body Are Defective

June 20, 2016 – – TheProductLawyers.com reports on IVC filters that are surgically implanted into a patient’s body, specifically in the largest vein, the Inferior Vena Cava. This vein is instrumental in transporting blood to the body’s most important parts, such as the heart and lungs. These devices help prevent a pulmonary embolism that can occur when a blood clot blocks a pulmonary artery thus creating a life-threatening situation and in some instances, a fatal one.

Controversy has emerged related to several brands of IVC filters with a number of class action suits being filed against the devices manufacturers, specifically in Canada, against Cook Medical. Patients in these class action suits allege that the IVC filters were manufactured defectively and fractured in the body, or have come loose and were transported to other parts of the body, causing serious medical issues in these patients.

The first of the two class action suits involves a woman who had the device implanted in August of 2013 as a precaution in order to prevent blood clots from moving from her lower body to her lungs and heart. The IVC filter was used because the woman was unable to take traditional blood thinner medications.

The FDA has stated that the IVC filters should be removed from the body within 29-54 days after the initial implantation procedure to avoid any medical complications since the device is meant as a temporary situation until the risk of blood clot subsides. When doctors went in to remove the device from this particular plaintiff, they discovered the filter had moved and trying to remove it from its new location would have presented serious risks.

In the second case, doctors tried to remove the filter twice without success, with a third surgery planned that was later determined to be too risky. The plaintiff in this case now says he suffers from dizzy spells since the device may be clogging the flow of blood in his body.
