MDL Involving IVC Filter Lawsuit Filings Continues To Move Forward

June 20, 2016 – – TheProductLawyers.com reports on recent steps in IVC filter litigation against C.R. Bard. District Judge David Campbell issued Case Management Order No. 11 in May to move forward with the selection of bellwether cases. The order states that initial plaintiff pools for the process are to include all cases filed in MDL 2641 as of April 1, 2016. Groups were given a deadline of June 29, 2016, to compile lists of 24 representative cases to continue to bellwether trials.

The litigation focuses on the use of the companies’ IVC filters. The cage-like devices are used to catch blood clots before they can reach the lungs and are used in patients at risk of pulmonary embolism. Patients have alleged, however, that the devices can break apart while in use and migrate to other parts of the body causing perforation and blockages. Issues involving IVC filters have included device migration, filter fracture, perforation, and embolizations. The FDA stated that between 2005 and 2010, it received 921 reports of adverse events related to the filters.

Many patients who have suffered from these issues have filed lawsuits against companies such as C.R. Bard and Cook Medical. These cases claim not only that the devices have caused serious health risks but that the companies knew of the risks and continued to market them. These cases, which have now reached numbers in the hundreds, have been combined in MDLs in Arizona and Indiana.
