One day Mary, an elderly woman, answered her phone. It was an unknown debt collector telling her that she owed an old credit debt, and that a court summons for that debt was about to go in the mail to her. Mary had no idea what he was talking about, but was afraid she had forgotten about this debt. The collector told her she could prevent this from happening if she made a payment over the phone to him. All she had to do was give him her bank account access information, and he would withdraw $200 from her account. She did, and he did. A few days later when Mary went to pay for her groceries she learned that he had cleaned out her bank account, taking the full balance owed plus claiming liberal penalties and past interest owed on that debt.

Today seniors are being harassed by debt collectors for debt they have already paid, for debt they never owed, for old debt that is beyond their state’s statute of limitations for collection, for the debt of a deceased spouse or relative, or debt they simply cannot afford to pay.

Seniors are more likely to be at home and at their phone. They may live alone or be unable to receive counsel from someone they trust, or they may be forgetful and easily intimidated. He points out that debt collectors work on commission. If they do not collect any money, then they do not make any money, he says.

According to Thompson, the immediate solution to an ambush phone call is simple. The answer to any debt collector’s threatening phone call should be, “ I am sorry, but I do not discuss my personal financial affairs over the telephone with strangers. You could be anyone including an identity thief or a scammer. Please put your claim in writing.” Then, hang up the phone, he says.

If you are a senior or someone carrying for an elderly parent, do not bury your head in the sand when it comes to unaffordable credit card debt, Thompson warns. He says debt collectors perceive resistance as less profitable and non-resistance as more profitable. Debt collectors will focus on those consumers who are uneducated about their consumer protection rights, he adds.
