More IVC Filter Lawsuit Cases Expected To Be Added To MDL Against Cook Medical, As Plaintiffs Await Settlement Conference

June 24, 2016 – – TheProductLawyers.com reports on a proposed settlement conference originally scheduled for March 2016 related to the numerous lawsuits filed by plaintiffs against Cook Medical due to alleged defects in its IVC filter. Cook Medical requested the date pushed back from its originally scheduled March 2016 date and is now seeking yet another deferment of the settlement conference so its legal advisors can further research and investigate claims made by the plaintiffs. The intent of the settlement conference is to get all parties involved before a U.S. Magistrate Judge in order to discuss and negotiate a possible settlement to negate the need to go to trial. Plaintiffs are anxiously awaiting word on a new date for the settlement conference.

There have been over 250 cases filed against Cook Medical claiming its IVC filter was manufactured defectively. Plaintiffs claim that the cage like filters move from the point of original insertion in their inferior vena cava veins. In some cases, plaintiffs claim the device has relocated to what are considered more “high risk” areas of the body. The devices have also allegedly fractured with pieces migrating to other parts of the body and lodging into “high risks” locations as well. Many of the patients experiencing such movement and fractures have been told by their doctors that the device and/or pieces cannot be surgically removed because of the relocation to riskier parts of the body. These patients now live in fear of life-threatening consequences due to potential subsequent migration.

In October 2014, the U.S. Judicial Panel on Multidistrict Litigation (JPML) has consolidated the cases into a multidistrict litigation (MDL) thus “fast tracking” them. The MDL will be overseen in a court in the Southern District of Indiana. Cook Medical and plaintiffs are preparing for trial which is expected to take place in the beginning of September 2016.
