Attorneys In IVC Filter Lawsuit Cases Filed Against Cook Medical Prepare For September 2016 Trial
June 25, 2016 – – TheProductLawyers.com reports on allegations made by plaintiffs filing lawsuits against Cook Medical and the IVC filter devices they manufacture. IVC filters are surgically implanted into a patient’s body, specifically in the inferior vena cava vein, to prevent blood clots. The small cage-like devices are frequently used in patients that cannot take traditional blood-thinning medications and who are prone to the development of blood clots. The filters are designed to prevent clots from reaching the heart and lungs traveling from the lower body to prevent pulmonary embolism or stroke. The placement of the filter should be a temporary situation for most and should be removed when the risk of embolism has passed.
It has been claimed by plaintiffs filing lawsuits that the devices have actually moved from the original insertion locations. It has also been alleged that the devices have fractured in some instances. Due to the migration of the pieces of the device that fractured, several plaintiffs claim to be in jeopardy of life-threatening situations if those pieces were to become lodged in or puncture vital organs and veins. Removal of the pieces would then become impossible given their “high risk” locations, and would leave the patient with possible long-term adverse health impacts.
Due to the number of lawsuits filed, a Multidistrict Litigation (MDL) was created by the U.S. Judicial Panel on Multidistrict Litigation (JPML) in order to expedite the movement of the cases in the legal system. This consolidation was possible because the defendants and allegations are the same in each of the individually filed lawsuits. Attorneys and plaintiffs have been preparing for trial since the MDL was created by the JPML and trials are expected to begin in early September of 2016. The MDL is being overseen in a court in the Southern District of Indiana.
