Xarelto Lawsuit Receives Federal Attention And Growing Public Concern

June 27, 2016 – – TheProductLawyers.com provides details on the recent developments surrounding the complaints against the drug, Xarelto. Litigation seeking reparation from the drug companies Janssen Pharmaceuticals (a branch of Johnson & Johnson) and Bayer AG has grown to more than 3,000 individual cases. Many of these suits allege similar detriment directly related to taking the drug.

In the interest of expediting the proceedings, the U.S. Judicial Panel on Multidistrict Litigation has merged 2,800 of these cases into a single multidistrict litigation (MDL). MDL No. 2592 is being overseen in the Eastern District of Louisiana. Similarly, a mass tort program comprising 550 individual suits was consolidated by the Court of Common Pleas in Philadelphia, Pennsylvania.

Plaintiffs in many of the individual cases allege that manufacturers neglected to properly warn patients and physicians about a possible elevated risk for the occurrence of sudden dangerous bleeding episodes in patients taking the anticoagulant. Therefore, they were placed in harm’s way without due knowledge. It is hoped that such combination of individual cases will allow the courts to hear the evidence and issue rulings on the matter in a timely fashion.

In 2011, the FDA approved the new-generation anticoagulant. The drug was designed to treat individuals who suffered from deep vein thrombosis or pulmonary embolism and patients recuperating from hip or knee surgery by preventing the formation of clots. Following the initial approval, its uses were expanded to treat those with atrial fibrillation, a heart condition that can increase the risk for stroke.

Plaintiffs currently awaiting trial have found some comfort in the fact that their Xarelto complaints very closely mirror previously settled lawsuits filed against blood thinner Pradaxa. Pradaxa cases were settled by the defendant outside of court, and many of the plaintiffs involved in Xarelto lawsuits are hoping for a similar outcome.
