Xarelto Lawsuit Plaintiffs Prepare As JPML Consolidates Cases

June 28, 2016 – – TheProductLawyers.com reports on the progress of the cases against Xarelto and its manufacturers—Janssen Pharmaceuticals (a division of Johnson & Johnson) and Bayer AG. Numbering in excess of 2,800, the plaintiffs filed a petition with the U.S. Judicial Panel on Multidistrict Litigation (JPML) on October 15th of last year. They requested that all lawsuits with similar allegations against Xarelto be combined. Additionally, they petitioned that the cases be heard in the Southern District of Illinois, a motion disputed by the defense. Lawyers for the defense cited New Jersey as a logical venue for the trials since many of the corporate offices for the drug manufacturers are located there.

Following weeks of hearings, in which the evidence for the consolidation claim was thoroughly evaluated, the JPML released a statement. On December 4th, they stated, “In our judgment, the considerable growth in the litigation over the past few months demonstrates that informal coordination is not practical.” Consolidation of the cases serves multiple purposes. First, it will conserve time, money, and public resources by facilitating the judicial process. Second, it will prevent spurious acts of discovery on the part of the defense. Third, it will function as a collection for all subsequently filed federal court cases against Xarelto.

The JPML approved a neutral court location for the hearings, which will take place in the Eastern District of Louisiana. In addition to the benefits of combination for all concerned, they felt a single presiding judge would streamline verdicts, preventing the wildly varying interpretations of the law that can result from informally organized lawsuits of this magnitude.

They observed in their statement, “Judge Eldon E. Fallon, who presides over three potential tag-along actions, is an experienced transferee judge with the willingness and the ability to manage this litigation efficiently.” The JPML cited his experience with other MDLs and stated their confidence in his sound judgment.

Even as the plaintiffs await their day in court, they are confident that additional lawsuits will be brought against Xarelto. In Pennsylvania, a mass tort program comprising 550 claimants is already been consolidated by the Philadelphia Court of Common Pleas. Plaintiffs in the MDL take this development as a positive sign.
