IVC Filter Lawsuit Plaintiffs Push For Settlement, As Cook Medical Requests Later Conference Date

June 28, 2016 – – TheProductLawyers.com reports on the increasing controversy surrounding the use of IVC filters manufactured by Cook Medical. There have been a number of federal lawsuits filed by plaintiffs claiming that the small, cage-like devices are defective in that they have broken apart after being surgically implanted into the patient’s inferior vena cava vein. Allegedly, the pieces have then migrated to other areas of their bodies where patients have been told by their doctors that they are considered to be too “high risk” and therefore are unable to remove the pieces. Some plaintiffs claim that they live their lives with a high degree of uncertainty since the pieces could move again and cause life-threatening consequences.

There are currently over 250 federal lawsuits pending against Cook Medical. However, these cases have been consolidated by the U.S. Judicial Panel on Multidistrict Litigation (JPML) into a multidistrict litigation (MDL) in October of 2014 in order to fast track the litigation process. The JPML placed oversight of the MDL with a sole court in the Southern District of Indiana. The initial trials are expected to be heard in the early part of September of 2016. It is expected that more cases will be added to the MDL over the coming months.

While waiting for the start of the trials, plaintiffs are hopeful that a settlement can be reached negating the need to go to trial. A settlement conference was initially scheduled for March 2016 during which all parties involved would have tried to potentially negotiate a settlement before a U.S. Magistrate Judge. However, the settlement hearing was postponed at the request of the attorneys representing Cook to allow more time to prepare and to further review and research documentation related to the filters.
