Ohio Xarelto Lawsuit Joins MDL
June 30, 2016 – – TheProductLawyers.com announces another case to join the multidistrict litigation (MDL) 2592. In response to an appeal to combine these cases, the U.S. Judicial Panel on Multidistrict Litigation (JPML) announced late last year that more than 2,800 cases would be amalgamated into MDL 2592. Further, any subsequent individual cases with similar allegations that were brought before a federal court would join the MDL. An Ohio husband and wife are seeking more than $150,000 in damages from Xarelto manufacturers, Janssen Pharmaceuticals (a division of Johnson & Johnson Corporation) and Bayer AG.
While the FDA approved Xarelto to treat patients with deep vein thrombosis and pulmonary embolism in 2011, it has since issued two black box warnings against the drug. This measure can often directly precede an outright recall of the product from the market. The drug was also approved to mitigate the formation of clots in patients recuperating from hip or knee replacement surgeries, and to reduce the risk of stroke faced by individuals with atrial fibrillation.
Initially embraced by the medical community as a breakthrough anticoagulant, the new-generation blood thinner has since lost its bloom. Plaintiffs who are represented in MDL 2592 and the mass tort program consolidated by the Philadelphia Court of Common Pleas, allege that taking the drug placed them at an increased risk of suffering catastrophic bleeding events without their knowledge. In many of the cases, injuries are claimed, up to and including death.
The Ohio couple claims that the woman began taking Xarelto as part of a stroke prevention regimen because she suffers from atrial fibrillation. However, two months later, she suffered an uncontrolled intestinal bleed that required medical intervention and resulted in anemia and other medical issues. Their suit states that these developments impair her ability to lead a normal life, and will require ongoing medical care.
As the plaintiffs in MDL 2592 await their court dates, they are confident that additional lawsuits will continue to be filed.
