Xarelto Lawsuit Cases In MDL Continue To Grow
June 30, 2016 – – TheProductLawyers.com reports on the case of an Ohio couple, seeking damages from Bayer AG and Janssen Pharmaceuticals (a subsidiary of Johnson & Johnson) in relation to the anticoagulant Xarelto. Their case will join the multidistrict litigation (MDL) 2592, currently awaiting the beginning of bellwether trials and being overseen in the Eastern District of Louisiana. The U.S. Judicial Panel on Multidistrict Litigation (JPML) formed the MDL late last year as a response to petitions to combine the more than 2,800 cases. The JPML additionally stated that subsequent suits with similar claims brought before federal courts would be added to the MDL.
In 2011, the FDA approved Xarelto to treat individuals with pulmonary embolism or deep vein thrombosis and as part of a clot-preventative regimen in patients recuperating from hip or knee replacement surgeries. The drug was later approved to treat those with atrial fibrillation, a cardiac disorder that heightens the risk for strokes. However, while the drug was hailed as a breakthrough anticoagulant, the new-generation drug has since earned two black box warnings from the FDA. These are the most severe measures the FDA can take prior to issuing a recall order for the medication.
The plaintiffs of the MDL allege that taking the drug exposed them to an increased risk of catastrophic bleeding events, many of which resulted in injury or even death. The case of the Ohio couple parallels these claims, alleging that only two months after beginning a Xarelto regime due to her atrial fibrillation, the woman suffered a severe intestinal bleeding event. This, in turn, resulted in anemia and other medical complications that require ongoing treatment and prevent her from living a full life. The couple is seeking more than $150,000 to cover bills in relation to the event.
While the plaintiffs of MDL 2592 still await their days in court, they are confident that claims against the drug manufacturers will continue to appear and be merged with the MDL. A mass tort program with similar allegations was created by the Philadelphia Court of Common Pleas. It alone represents 550 individual claims.
