IVC Filter Lawsuit Filed By Pennsylvania Man Against Cook Medical

June 30, 2016 – – TheProductLawyers.com reports on a lawsuit recently filed in Pennsylvania against the manufacturers of IVC filters. Reports indicate that in May of this year, a Pennsylvania man filed a lawsuit (Case no. 2016-SU-1406-71) against Cook Medical claiming they concealed risks and falsely promoted the filter as safe. The plaintiff had the device implanted in June 2012 and was allegedly told that there was no need for follow-up medical care. The plaintiff had surgery to remove the filter in December 2015 when doctors discovered that the filter was tilted and that it had embedded in the walls of his inferior vena cava. The filter had also allegedly broken and pieces had travelled to his heart. A January 2016 surgery to remove the pieces was unsuccessful and he is now at risk of serious health problems, according to the suit.

Unfortunately, many other patients are familiar with his grievances. The FDA stated that between 2005 and 2010, 921 adverse events related to IVC filters were reported to the FDA. Among those reports, many indicated issues such as filter migration, perforation, filter fracture, and embolization. Some patients have also opted to file lawsuits against manufacturers such as C.R. Bard, Cook Medical, and Boston Scientific claiming that, in addition to suffering health complications, the companies knowingly marketed a defective device. These cases, which have now reached hundreds in number, have been combined into MDLs in Indiana and Arizona.

IVC filters are cage-like devices that are made to prevent blood clots from flowing to the lungs. Patients with a high risk of pulmonary embolism are usually candidates for the device, particularly if they are unable to take anticoagulant drugs. The FDA recommends that these devices be removed as soon as possible, however, once the risk of pulmonary embolism has decreased. Studies have linked the amount of time the device is inside the body to the likelihood of serious side effects.
