Negligence And Exposure To Harm Among The Claims In Xarelto Lawsuit
July 04, 2016 – – TheProductLawyers.com announces developments in a lawsuit of a New Jersey man against Xarelto and its manufacturers—Bayer AG and Janssen Pharmaceuticals. Filed in the Eastern District of Louisiana in November of 2015 under case number 2:15-cv-06264, he alleges that the manufacturers were negligent in failing to warn consumers of the potential risks associated with the drug. He cites a massive gastrointestinal bleeding event he suffered after only six months of taking Xarelto, which required medical intervention and will continue to require care, as a basis for his claims.
His case joins more than 2,800 similar cases with common allegations of negligence and elevated risk of dangerous bleeding events when taking the drug. In response to a petition for combination, the U.S. Judicial Panel on Multidistrict Litigation (JPML) agreed to form the multidistrict litigation (MDL) 2592. Any subsequent suits brought before federal courts will join this MDL, slated to be tried in the Eastern District of Louisiana under the supervision of Judge Eldon Fallon. Similarly, a mass tort program representing 550 individual suits will appear before the Philadelphia Court of Common Pleas.
