IVC Filter Lawsuit Plaintiffs Claim Devices Have Potential To Migrate To Vital Organs, Causing Life-Threatening Health Risks
July 18, 2016 – – TheProductLawyers.com outlines several allegations from IVC filter lawsuit plaintiffs, stemming from events cited in other filed lawsuits. Some plaintiffs allege that the devices within their body migrated, and traveled away from its original insertion point, moving towards vital organs like the heart and or lungs. Traditional IVC filters in the past were made of titanium, or steel, however, nowadays popular filters are made with other metal alloys. Current filters tend to adjust shape in colder temperatures, therefore, in several cases patients claim that their filters detached from the vena cava traveling upward towards their pulmonary artery.
In one such case, according to Michigan’s William Beaumont Hospital, a local 54-year-old IVC filter patient suffered from an abnormally rapid heart rate and was assessed with non-q-wave myocardial infarction, which is a less serious form of heart attack. Reportedly, this adverse event stemmed from filter migration, as the man’s IVC filter had shifted into the right ventricle of his heart and caused detrimental damage. Common symptoms of IVC filter migration are chest pain, fainting, abnormal heart rhythms and palpitations.
The devices were initially constructed to capture blood clots, and minimize the risk of a clot reaching a patient’s’ vital organs. As of late, the devices have been under heavy public scrutiny, mainly due to the multitude of patients alleging that their IVC filters have caused devastating side effects. Many plaintiff allegations include the claim that device manufacturers knowingly released defunct IVC filters, and have continued to produce the devices, despite increased reports of adverse side effects.
A wide array of patients have recently filed lawsuits against IVC filter manufacturers, Cook Medical and C.R. Bard, claiming that the 2 companies were aware of the potential consequences of their devices, yet continuously manufactured and sold them. Thus far, there have been two Multidistrict Litigations (MDL) consolidated in the U.S, both of which are progressing towards bellwether trials. One MDL was formed in Arizona (No.2641) which names C.R. Bard as the defendant in all suits and a second in the Southern District of Indiana (No. 2570) names Cook Medical as the defendant.
