Multidistrict Litigation Progresses As Xarelto Lawsuit Plaintiff Claims Father Died Due to Brain Bleed While Taking Xarelto

September 11, 2016 – – TheProductLawyers.com reports on Xarelto, a new-generation blood-thinning drug that has swiftly become the focus of over 3,000 lawsuits since its release to the market. Of this amount, 2,800 federal cases have been consolidated in a multidistrict litigation (MDL) under the jurisdiction of a Louisiana federal court by the U.S. Judicial Panel on Multidistrict Litigation (JPMDL). The panel decreed that they should be consolidated due to the very similar allegations being made that the drug caused excessive and uncontrollable bleeding and that in many cases the result was fatal. The panel also stated that consolidation was prudent since all of the cases were filed against the same plaintiffs, Janssen Pharmaceuticals, a subsidiary of the Johnson and Johnson Corporation, and Bayer AG.

In relation to the MDL, a monthly status conference was held in February 2016. The cases are slowly working their way through the court system toward their day in court with the selection of bellwether trial selections. This consolidation will serve to hasten court review and prevent duplicative discovery processes, as well as save a lot of time and money to be expended by those involved in the litigation.

Additionally, the Court of Common Pleas in Philadelphia, Pennsylvania consolidated another 550 cases together in a mass tort program. These cases also had similar allegations levied against the same defendants.

One of the cases originally filed in a Vermont Federal Court as number 2:14-cv-00159-cr but now part of the MDL, was by a plaintiff who alleges that her father suffered a brain bleed, otherwise known as a parenchymal hemorrhage, while he was taking Xarelto. Doctors were unable to stop the bleeding by clotting it because Xarelto was in the man’s system, thus causing the death of the plaintiff’s father.
