Plaintiffs In Talcum Powder Lawsuit Remove Rio Tinto As A Defendant
November 08, 2016 – – TheProductLawyers.com reports on a recent article by the Sydney Morning Herald involving the removal of Rio Tinto from a list of defendants in a talcum powder lawsuit.
According to the news source, plaintiffs have altered their claim to replace Rio Tinto with Imerys, the company that, in 2011, purchased Rio Tinto’s talc operations. Aside from the change of defendants, the plaintiffs’ allegations have not changed. The suits, which were based in Louisiana have since been moved to New Jersey along with several other cases.
One of the major companies named in these and similar suits is pharmaceutical giant Johnson & Johnson. The company currently faces over 1,000 lawsuits nationwide related to their talcum powder products. Plaintiffs claim that the products are linked to the development of ovarian cancer and plaintiffs have cited research over the past 40 years linking the two. While some studies and juries have found a connection, other studies have found evidence inconclusive that a relationship exists between the product and the deadly disease. Johnson and Johnson has denied such claims and has not issued a warning for the products.
As a result of the alleged effects, many women have claimed that Johnson & Johnson should face fraud, negligence and other charges after failing to warn consumers about the alleged risks of the product. So far, Johnson & Johnson has been made to pay millions in compensation after juries in three different cases found that they should be held responsible for damages done to plaintiffs.
As these cases are expected to grow in number, Banville Law is seeking to help those currently suffering. The firm has many years of experience fighting large pharmaceutical companies who have put dangerous drugs and devices onto the market, foregoing public safety for corporate greed.
