Pharmaceutical Company Avoids Trial With Levaquin Lawsuit Settlements
April 10, 2017 – – Thousands of cases filed against pharmaceutical giant Johnson & Johnson may never see the inside of a courtroom. Reports show that the pharmaceutical company has been settling many of these claims out of court, often just days before trials have been scheduled to commence.
A spokesperson for www.levaquin-lawsuit.org says, “It stands to reason that the company would avoid a court trial, particularly if they know that they are going to lose their case. Many claimants have received settlements and at the same time, avoided having to be in a courtroom for an interminable amount of time while a trial by jury takes place.”
The majority of the claims filed against Johnson & Johnson state that patients who took Levaquin developed debilitating nerve damage or peripheral neuropathy as a direct result of taking the drug. In 2004, statements were added to the labels of all drugs in the fluoroquinolone antibiotic class to warn consumers that there was a risk of developing this disease while taking these medications. Plaintiffs in these cases state that the labels were not worded properly and that they indicated only a rare chance of developing the disease.
In 2013, the FDA ordered the drug class to include a label stating that this condition could be permanent. They also required manufacturers to remove wording that indicated that this condition was only a rare side effect of the drug.
“By that time,” says the spokesperson for Levaquin-lawsuit.org, “thousands of people had already taken the medication and were affected by the side effects.”
The lawsuits currently include Levaquin as well as Avelox and Cipro, all part of the fluoroquinolone drug class. A number of claims have been filed in courts throughout the United States on behalf of patients who also experienced aortic dissection or aneurysm while taking the drugs. While no settlements have been announced in these few cases, there have been numerous settlements made between plaintiffs and Johnson & Johnson.
