Group Health Insurance in Plano, Texas could once again be affected due to a lawsuit filed by over 20 states claiming the ACA is no longer constitutional given the insurance mandate has been eliminated.

Consumer options for health insurance in Plano may once again be impacted as 20 U.S. states, including Texas, have filed a lawsuit against the federal government over the Affordable Care Act (ACA). They claim that the current healthcare law, also commonly known as Obamacare, is no longer constitutional given the Trump administration’s repeal of the health care mandate passed in the tax bill law.
The lawsuit is being led by Texas Attorney General Ken Paxton and Wisconsin Attorney General Brad Schimel. Paxton has stated “the U.S. Supreme Court already admitted that an individual mandate without a tax penalty is unconstitutional”. Participants of the lawsuit contend that Obamacare has unfairly violated the constitutional rights of individuals like Plano health insurance consumers. Other states involved in the lawsuit include West Virginia, Arizona, Florida, Georgia, Utah and West Virginia- all having Republican Attorney Generals.
Republicans have been attempting to repeal Obamacare since its passage in 2010. The House of Representatives in Congress have voted over 50 times for repeal. The majority of these votes have been symbolic as the chance of repeal passing in the Senate had been low.
The individual mandate which required younger and healthier people to purchase insurance was originally included in the ACA to diversify the health insurance risk pool. This has allowed families and individuals access to health care previously unattainable, particularly for those with pre-existing conditions.
Rick Thornton, a Plano health insurance agent, believes this issue will be decided by the higher courts. “The ACA has been effective for many states like California and New York. They will fight to preserve the mandate or risk seeing their state plans become cost prohibitive. I think the Supreme Court will ultimately determine how much of Obamacare is eliminated,” he stated. The U.S. Justice Department has not publicly stated whether they will defend against the new lawsuit but experts believe the Sessions-led agency will most likely decline.
