Jeri Muoio’s Campaign Alleges Mitchell’s Campaign Behind New PAC, Files Election Complaints for Violations

There Are Two Kinds Of Groups That Spend Money During Elections; One Set of Groups Are the Actual Candidate Campaigns and the Other Groups Are So-Called “Political Action Committees” Or PACS

WEST PALM BEACH, FL / ACCESSWIRE / March 10, 2015 / Florida State Statutes made it very clear that these two groups, when it comes to spending money, must have NOTHING TO DO WITH EACH OTHER. State laws put strict rules in place to require this separation to protect the process, and ensure that candidates cannot secretly spend piles of money without reporting it. But an email that was mistakenly sent out by a print shop hired by a PAC shows the same people running the Kimberly Mitchell campaign are also running the West Palm Beach PAC.

Several days ago, the Muoio Campaign was forwarded an email communication between three people: Kim Mitchell’s campaign manager, her political advisor and a printer working with a newly formed PAC called the South End Political Action Committee (SEPAC).

Records show SEPAC was created just one day before Kimberly Mitchell filed to run as Mayor, as an independent grassroots voice of local residents. This past week, SEPAC sent thousands of residents two pieces of mail telling them to vote for Mayoral candidate Kim Mitchell and two other commission candidates – Len Fintzy and Cory Neering.

The mailings claimed to come from an independent group, with no coordination or knowledge by any of the candidates or anyone associated with their campaign.

But the email proves otherwise. The email originally was sent by SEPAC’s printer by accident to the daughter-in-law of City Commission candidate Katherine Waldron. Waldron took the email and shared it with both the Muoio campaign and the Keith James campaign – since SEPAC opposed all three of them and favored their opponents. It was an accidental email by SEPAC’s printer that has become the smoking gun.

The email and attachment showed that SEPAC is not a grassroots, locally funded and independent citizens group. They are misleading voters. Incredibly, the email was sent to Mitchell’s Campaign Manager Beth Kennedy and Campaign Advisor Richard Pinsky, who is also Mitchell’s ex-husband and a prominent local lobbyist.

The email from the printer seeks their approval for the mailer and arrangements for paying for it.

The Muoio campaign is alleging that the collaboration shown in the email between Kennedy, Pinsky and the SEPAC are a clear violation of state election laws.

Complaints were sent to Tallahassee Saturday against SEPAC, Mayoral candidate Kim Mitchell and Commission candidate Len Fintzy, since Fintzy also works with Beth Kennedy according to his campaign reports. The complaints allege there are multiple campaign violations and if found guilty each candidate and SEPAC could face tens of thousands of dollars in election violation fines that they would have to pay for personally.
