When asked to comment, La Rue said that in recent years, law enforcement has narrowed its focus on sex crime cases.

La Rue continued, “Before, unless there was some type of physical evidence that would back the word of the accuser, the case would often simply die right then and there. But now, there’s greater scrutiny by law enforcement to try to make cases, often, based only on the accusations of the accuser.”

According to La Rue, this is because there has been an “empowerment of the victim,” which has led to an “enormous amount of support for those bringing charges, regardless of the evidence, or lack thereof.” This support – particularly in Ohio – comes in the form of laws that allow victims to speak in open court on issues ranging from bond to sentencing.

In this landscape, La Rue said that anyone who has been accused of a sex crime should tread carefully when it comes to speaking about the case.

When asked to elaborate, he commented, “I would ideally recommend that you speak only to those people that you absolutely know have only your best interests at heart. And frankly, that often is an extremely small circle of people – most important of which is an attorney.”

La Rue further added that seasoned criminal attorneys such as himself need to know all the facts in order to craft the best defense possible.

When asked to elaborate, he said, “It’s not always obvious what counts as crucial information or what might be essential to know. Share everything and be transparent with the attorney.”

Counterintuitively, it’s crucial that clients reveal even the most embarrassing details. In doing so, La Rue stated, the attorney has the very best chance of avoiding surprises and can properly position the case for possible resolution through filings and arguments in court.

When asked for an example, La Rue mentioned a medical student he represented who was accused by another medical student of committing a rape.

“But upon his trusting me, ultimately, I was able to present a case to the prosecution that was sufficiently verrified by independent facts, such that charges were never brought against this young man – and he was never charged with the offense of rape or any other sex offense whatsoever.”
