Pottroff Law Office, P.A. and Tatum and Atkinson, PLLC Moving Forward with Lawsuit Seeking Damages for Victims of North Carolina Amtrak / Truck Crash

RALEIGH, NC / ACCESSWIRE / April 13, 2015 / Victims of the Amtrak train tragedy in North Carolina that injured over 50 people are taking the important step of seeking legal representation and filing their lawsuit (Halifax County Superior Court 15-CVS-313) seeking damages for their injuries to make sure their rights are preserved.  Bob Pottroff of Pottroff Law Office, P.A. has been retained by victims to investigate the tragedy and bring justice to the victims and their families. Bob Pottroff is a nationally renowned attorney who, over the past 30 years, has focused his practice on successfully advocating for railroad crossing accident victims.

Pottroff Law Office has joined forces with North Carolina based attorney Robert Tatum of Tatum and Atkinson, PLLC, who also represents some of the victims. North Carolina attorney Paul Coates of Pinto, Coates, Kyre & Bowers, PLLC, will also help prosecute this lawsuit.  C. It is virtually certain that a simple technology could have prevented this crash as well as another Amtrak crash that occurred in New York just a few days ago.  This simple technology is Positive Train Control (PTC). PTC is a technology that could have notified the Amtrak train well in advance that the crossing was occupied.  This advance warning could have given the train crew enough time to stop the train before it hit the tractor-trailer.  Since 2011 there have been at least 24 collisions on Class One freight and passenger commuter railroad tracks that a PTC system could have prevented.  Those incidents resulted in a total of at least 13 deaths and 187 injuries, most of them serious.

Among the other factors being investigated is whether the tractor-trailer driver was properly trained to navigate the truck over the crossing and whether the trucking company took the appropriate precautions when transporting heavy, over-sized machinery and equipment.

While this tragedy occurred almost a month ago, the pain and loss the victims and their families are suffering will last a lifetime.
