Obama Administration To Propose Overtime Pay Expansion Says California wage and hour lawyer

Millions of Americans may soon be eligible for overtime pay, says California wage and hour lawyer Eric Grover.

Washington, DC—Overtime pay protections may soon be extended to low-salaried employees, as the Obama Administration is expected to make a proposal increasing the salary threshold that requires overtime compensation, reports California wage and hour lawyer Eric Grover of the Keller Grover law firm.

The proposal is expected to extend overtime wages to employees whose salary falls somewhere between $42,000 and $52,000 annually, which could affect millions of workers, CNN Money reported.

Currently certain workers making only $23,600 annually are not eligible for overtime wages, which comes out to $455 per week (http://www.cawagehourlaw.com/overtime-violations_21.html).

If the overtime threshold was increased to $42,000, 3.5 million workers would immediately become eligible for overtime pay. An additional 2.6 million would benefit if it was raised to $52,000, the Economic Policy Institute reported.

The National Employment Law Project wants the salary threshold to be raised to at least $51,168.

In addition, advocates want the Labor Department to clearly define non-exempt employees to help prevent phantom promotions in name only in order to forgo paying overtime wages.

“Increasing the minimum wage threshold will help many families who are overworked and underpaid,” Grover said. “Employers often give an employee a title and a minimum salary just above the threshold to avoid overtime wages and routinely require them to work over 40 hours per week. This proposal will help families receive overtime wages or it will prompt companies to increase their salary to avoid overtime. Either way, workers will win.”
