Paulson & Nace, PLLC Files another Representative Action against GNC

The Washington, D.C. law firm of Paulson & Nace, PLLC, has joined forces with Nidel Law, PLLC, and Whitfield Bryson & Mason, LLP, to bring a representative action against General Nutrition Corporation for deceptive trade practices used in the packaging of their products.

The Washington, D.C. law firm of Paulson & Nace, PLLC, has joined forces with Nidel Law, PLLC, and Whitfield Bryson & Mason, LLP, to bring a representative action against dietary supplement giant General Nutrition Corporation (GNC) for deceptive trade practices used in the packaging of their products. The original lawsuit, filed on March 26 in Superior Court of the District of Columbia by Amanda Huffman, has been removed to the U.S. District Court for the District of Columbia.

“Companies like GNC believe that consumers won’t resist this unlawful trade practice, but we have now seen that consumers have had enough,” said co-counsel Jonathan B. Nace. “What GNC and other offenders are doing is misleading the consumer for the windfall of higher profits. It’s an intentional act to make it more difficult for the consumer to appreciate and understand what they are bargaining for.”

The lawsuit centers on “slack-fill,” the name for the empty space between the top of a container and where the actual product begins, and the opacity of those containers. The complaint specifically mentions GNC’s Herbal Plus line, Ginkgo Biloba Plus and Saw Palmetto Extract. Four more complaints alleging the same deceptive practices have been filed as well.
