When asked for a comment, she said, “Not all mediators are created equally. When you research into the best mediator to choose, you’ll want to find someone who is well-rounded enough to help with many of the issues that come up while dissolving a marriage. In the end, this will result in a much easier divorce process.”

Couples who choose to work with mediators experienced in family law are much better off.

“Some therapists are mediators, and some people have other types of skills who, after taking a mediation class, offer mediation services. However, there tend to be problems with how mediators who are not family law attorneys come up with the agreement or memorandums of understanding that are not very clear. Or they might come up with terms that a lawyer is not able to then put into an agreement.”

DePalo further added that it’s often simpler to go to a lawyer mediator since they both mediate and draw up agreements.

“This is the better route to take. Anyone experienced in family law is well-versed in the issues that arise later as a result of not having a good agreement or a clear understanding of what you’re both obligated to or responsible for.”

DePalo was quick to add that getting a “one-stop-shop” mediation attorney helps to avoid confusion in communication, which will in turn eliminate obstacles and smooth out the divorce process.

“Hiring a mediator means that fewer players are involved in the divorce process. In a case that involves other lawyers or litigation as opposed to mediation, there’s always a lot of moving parts and going back and forth, which means that a lot of aspects of a divorce get lost in translation.”

Following this, finding a mediator who can wear different hats can help both parties even after the divorce process has been finalized.

“Just because an agreement has been reached doesn’t mean there’s nothing more to be done. There’s often a lot of unfinished business, such as refinancing, making changes to wills, and dividing assets from pension or retirement plans. You’ll want to find a mediator who is well-equipped to help move the process forward,” she said.

She continued by saying, “Issues about parenting also sometimes come up, so it’s a good idea to find a mediator who will allow you to book a follow-up mediation session to answer questions or even make tweaks to a custody arrangement if something isn’t going that well.”
