When asked to comment, he said, “The majority of Americans assume that all sex crimes are the same, however, this simply isn’t true. Being aware of the various terms associated with these charges is important, so you can fully understand the different offenses and potential consequences of a conviction.”

Sex crime allegations include rape, sexual battery, indecent exposure, solicitation, and unlawful sexual activity with a minor, among other crimes.

“Punishments for rape in the state of Tennessee are steep and could include prison time – which could be up to 60 years for a Class A felony – fines, compulsory registration on the national and state sex offender registries, and a criminal record,” he said.

Summers added that under the umbrella of rape, forcible rape requires that force was involved or there was a threat of force before the rape. Statutory rape occurs when an adult older than 18 engages in sexual activity with someone who is at least 15 and less than 18 or depending on the age of the victim, the offender is 4 to 10 years older.

“When it comes to statutory rape, it’s important to remember that consent doesn’t matter – even in cases in which the minor provided consent for sexual relations, it’s still considered rape under the law. Punishments for statutory rape cases are largely premised on the age difference between the two parties,” he commented.

Summers alluded to the fact that any rape allegation should be taken seriously as the legal repercussions are severe in the state of Tennessee.

When asked to elaborate, he said, “In Tennessee, the time that someone convicted of rape spends in prison can vary widely between 1 and 60 years depending on the particular offense. Rape of a child carries a minimum of 25 years in prison with a fine up to $50,000, and a statutory rape conviction could mean up to 6 years behind bars.”
