Paulding outlined a number of things that a suspect should be doing – including not talking to the police, not discussing the case with anyone close to them, and certainly not engaging with the accuser’s parents or guardians.

On a recent episode of the Five-Minute Legal Insights podcast, a forthright Paulding said: “My number one advice is not to talk to anyone, even your spouse or best friend. Get on the phone and speak to an attorney that is specialized in child sex crimes defense.”

Paulding said that any accusation made by a child of a sexually criminal nature should be taken seriously and investigated. “When a child makes an allegation of sexual abuse, a parent or guardian is going to experience a range of emotions which could include anger, concern and panic.”

“The situation can become volatile very fast and accusations can be made before they are fully investigated. It’s important that everyone slows down and allows for a thorough investigation to be conducted before anyone jumps to conclusions.”

She cited the case of Esther Thorne of Norfolk, who was sentenced to 17 years, ultimately serving five years, after being found guilty based on an allegation made by a ten-year-old who claimed she sexually assaulted him in 2014.

The case came down to the word of a child against that of Thorne. But several years later, the same child voluntarily recanted the allegation, saying it was a lie. Paulding said: “It took several years and court hearings before her conviction was vacated.”

Paulding said that if the police did turn up at someone’s door, they should take the officer’s business card and tell them they will call them back when they are ready to speak with him. Then call your attorney and see if this is a situation where you would want to speak with the police. Most of the time your attorney will advise you not to speak with anyone or at least wait until the attorney can be with you.

“If you get a lawyer and discuss the allegation, you want to strategize with them and talk things through before blindly walking into a police interview.”

She added: “If you are accused, take a deep breath, don’t panic, do not engage with accusers if they are calling you. But take action: call a lawyer specialized in this type of crime.”

Explaining the process, Paulding said that if the police approach you, take the lawyer with you and let them engage with the detective and take over the lead in the defense. “If you don’t hire a lawyer, you will be acting out of emotion, and then the lawyer may have to clean that up later, and that’s not the way you want to go.”

She said that in some cases, it might well be a waiting game for the investigation to progress, but a lawyer should be acting proactively. “If charges are being taken out, then a lawyer needs to turn you in and try to get a bond if you are held in custody.”

A timeline of up to two years from initial allegation to trial is not uncommon, with Paulding adding: “From the outset, I would advise the accused to get on a phone and talk to a specialist attorney to ensure they can get the full benefit of their advice.”
