One complication that can arise in the divorce process is if a child does not live in Tennessee. If the child has not lived in Tennessee for at least six consecutive months prior to the filing of the divorce complaint, Tennessee will not be considered the child’s “home state” and, as a result, the court in Tennessee will not have jurisdiction to make an initial custody determination.
Despite the foregoing, it may still be possible to address the child custody issues, in Tennessee, if the court in the applicable “home state” declines to exercise jurisdiction on the ground that a Tennessee court would be a more convenient forum. King says, “In order to explore this possibility fully, the client will need counsel from both a Tennessee lawyer and an attorney in the applicable home state.”
If the Tennessee court’s jurisdiction is not an issue, it will determine the child custody arrangement, including how much parenting time each party will receive, what the specific schedule will be (including holidays and vacation periods), who will make major decisions regarding the children, who will pay child support and how much, and who will provide health insurance and pay for uncovered healthcare expenses. Many factors go into making such determinations. King says, “The courts want to maintain as much continuity and stability as possible for children and they are required to give each parent the maximum participation in the children’s lives that is both feasible and in their best interests.”
Rather than leaving the determination of these important matters to a judge, King encourages parents to try to negotiate an agreement that can then be submitted to the court for approval.
King added, “While the divorce process continues, parents should be helping to protect their children from the emotional fallout. For that reason, Tennessee law prohibits one parent from bad mouthing the other parent in front of the children, and it is important to comply with that prohibition and not talk to the children about the case. This will help them adjust successfully to the change that will be happening in their lives when their parents split up.”
