• Call 911 and notify police and first responders about the accident.
• If you’re able, move your car away from traffic so you can be safe and other vehicles won’t strike you or your vehicle and wait for the police.
• Once you’re in a safe area, exchange information with the other driver. Politely ask for the person’s driver’s license and insurance card. Write down the driver’s name, address, telephone number, driver’s license number, name of insurance company and policy number.
• Ask who owns the car, because the driver may not be the owner.
• If you have a camera or smartphone with a camera, stay out of traffic and take pictures of the vehicles, any damage and the scene of the accident. If possible make a video of the scene. These pictures and video serve to save and protect evidence that may be used in any civil legal action or police investigation.
• “Assuming everyone’s OK, the most important thing you should do as soon as you can is to get legal advice,” Spear suggests, “Call a lawyer. Find out what your legal rights are and find out what information you need.”

You may need help finding someone to tow the car or repair the car, so whatever you need you want to talk to a lawyer in order to protect yourself in case you are injured and need legal representation.”
