About The Mass Tort Group In Philadelphia
The Philadelphia Court of Common Pleas decided to consolidate a group of individual complaints relating to Xarelto on January 22nd, 2015.
The decision to form a mass tort group in Philadelphia came after 75 separate complaints had been filed in Pennsylvania relating to the allegedly dangerous side effects of Xarelto.
Specifically, these complaints claim that the prescription blood thinner caused internal bleeding which led to serious injury and death.
Defendants In Xarelto Litigation Oppose Formation of Mass Tort
The defendants in the Xarelto litigation – namely drug companies Bayer AG and Janssen Pharmaceuticals – initially resisted the consolidation of cases in Philadelphia.
Bayer and Janssen argued that the mass tort should not be formed in Pennsylvania because their company headquarters’ were located in New Jersey and New York, respectively.
Additionally, the defendants argued that the cases should be consolidated in the federal Multidistrict Litigation (MDL) in Louisiana.
However, the administrative Judge rejected the opposition and ultimately agreed with the Plaintiffs that Philadelphia was an appropriate location for a Xarelto mass tort group.
