Phoenix Lawyer Jeffrey Phillips Announces $23 Million Vioxx Settlement Is Starting To Get Paid Out

September 04, 2015 – – In 2013, Phillips Law was at the forefront of a huge settlement case against Merck & Co in relation to their Vioxx product, as can be seen on PhillipsLaw.com. The case was settled for $23,000,000 after it was found that Vioxx had been misrepresented, which led to financial losses in a number of cases. Phillips Law is happy to announce that some of the money from the settlement are finally getting paid out.

Jeffrey Phillips says: “The Vioxx case is endless. Numerous people have made individual filings, many of which have been dismissed. There have also been several class action lawsuits. The case we were involved in, however, was settled for $23 million and we are happy to see that the affected families are finally starting to benefit from this.”

Claimants have two options. The first option is for those who have the prescribed proofs of purchase and prescription. They can recover out-of-pocket expenses in relation to the purchase of the drug and they may also apply for up to $75 for the reimbursement of expenses or losses resulting from any post-withdrawal medical consultation. The second option is for those who have an alternative proof of prescription. They can receive a one time payment of up to $50.

Phillips Law has explained that the settlement was agreed upon because it was unlikely that a trial class action would be sustainable. Vioxx was removed from the market in 2004, as soon as it was shown that the chance of suffering a heart attack was significantly increased if people used it for more than 18 months. It took around nine months to negotiate the settlement, because Merck felt they had taken all appropriate actions to stop people from being able to access the drug.

“The problem with these cases was that it is very difficult to show that injury actually took place,” adds Jeffrey Phillips. “We believe that, if the case had gone to trial, the ruling would have been reversed. As such, the settlement is in everybody’s best interest.”

Nevertheless, Merck is still facing a number of other lawsuits. These include personal injury lawsuits and purchase claims complaints. One of these suggests that Merck engaged in a number of illegal actions to push their drug to the market while being aware of its dangers.
