Zofran Lawsuit Filed Against GlaxoSmithKline By Missouri Family

October 05, 2015 – – ZofranLegal.com announced that the latest lawsuit in the growing Zofran litigation has been filed by the parents of a boy in Missouri.

Zofran, which is an anti-emetic, is a serotonin 5-HT3 receptor antagonist and is effective because it stops the action of serotonin which is a naturally occurring chemical that may cause nausea and vomiting. The drug was developed by GlaxoSmithKline and was approved by the U.S. Food and Drug Administration in 1991 to treat nausea and vomiting in cancer patients being treated with chemotherapy and radiation, or patients who were nauseous after anesthesia.

In order to receive approval from the FDA for the use of Zofran during pregnancy to treat the common side effect of morning sickness, GSK would have had to perform additional safety testing and clinical trials. The company decided against this and instead began to market the drug “off-label” to both the public and the medical community. Countless women were prescribed the drug by their doctors.

The latest lawsuit, filed on September 1st, 2015, in the Philadelphia County Court of Common Pleas under case number 2:15-cv-04912-LFR, alleges that a young boy born in 2006 suffered from a birth defect known as a cleft lip because his mother took Zofran while she was pregnant with him.

When the child was born, it was noted that his upper lip did not form correctly, leaving a hole from one side of the mouth to his nostril. He underwent corrective surgery as an infant, however, he was left with visible scarring. A second surgery when he was six was performed and was successful, yet he still has scarring. The complaint states that “In addition to visible scarring from his upper lip to his nose, the cartilage under his nostril is malformed, resulting in asymmetry. He has endured emotional trauma and teasing from his classmates as a result of the malformation caused by the defendant.”

On October 1st, the Judicial Panel on MultiDistrict Litigation convened and heard arguments as to why all Zofran lawsuits should be consolidated. At this time there are over 50 lawsuits filed against GSK. The panel will announce their decision in a few weeks.
