AndroGel Lawsuits Case Management Conference Update

October 16, 2015 – – Banville Law reports that the most recent case management conference for MDL 2545 was held yesterday in Illinois. MDL 2545 was created after many lawsuits appeared nationwide against AndroGel testosterone gel manufacturer AbbVie, Inc.. These cases are expected to head to trial in 2016.

In the litigation, plaintiff allegations state that AbbVie, Inc. failed to warn consumers about significant health risks associated with their AndroGel product. Additionally, they allege that marketing for the drug was done aggressively and misleadingly, and that the product caused them severe health complications including blood clots, heart attacks, strokes, and death.

Recent court records indicated that over 2,200 lawsuits concerning testosterone drugs have been filed in the Northern District of Illinois. This litigation has been rapidly growing since January of 2014, when, following several studies, the FDA launched a complete safety review of this class of drugs.

In March of 2015, the FDA required that manufacturers of prescription testosterone treatments increase the warnings on their labels to reflect the potential product association with increased risk of heart attacks and strokes. The Federal AndroGel lawsuits will be the first to appear in court, and will be reviewed as bellwether trials.

According to court documentation, during yesterday’s case management conference it was expected that counsel would present an agreed upon Discovery schedule. At this time, the United States District Court for the Northern District of Illinois’ website does not list a date for the next case management conference. MDL 2545 is being presided over by the Honorable Judge Matthew F. Kennelly.
