Phoenix Lawyer Jeffrey Phillips Takes On New High Profile Wrongful Death Case

November 12, 2015 – – Phillips Law has announced that they will be representing the family of Kaden Lanphear in a wrongful death case. Kaden, an autistic 8 year old boy, was killed by a train in Yucca, AZ. His father, Jimbo Lanphear, has filed a wrongful death claim for the death of his son, which was initially described as a tragic accident.

Jeffrey Phillips of Phillips Law Group says: “Kaden Lanphear left his home and apparently climbed aboard a freight train. He rode it for some 30 miles before climbing or falling off, which eventually led to his death. He was hit on the BNSF railroad tracks, but it is not clear whether he had already died before this. The fact that a child that age is able to climb aboard a freight train and remain undetected is, in the eyes of our client, a clear sign of failing security and this is what ultimately led to the death of his son.”

Jimbo Lanphear noticed that his son was missing one morning about an hour and a half after he had last seen him. The police launched a huge search in which thousands of community members were also involved. They combed the Needles, CA area until a report was received indicating that a BNSF train engineer around 11am that same morning had hit a child. This happened in Yucca, nearly 30 miles from the boy’s home.

While Mr. Lanphear was thankful for the efforts made by the police and the help the community offered, he feels that his son’s death was entirely preventable. It is not clear whether his son had died falling off a freight train, or whether he died when he was hit by the BSNF train engineer, who stated that he had seen the boy but was unable to stop in time to avoid hitting him. Either way, he feels that there were huge failings on the part of the railroad network who enabled a young boy to gain access to a freight train.

The Jeffrey Phillips Law Group will represent the Lanphear family in this wrongful death case. No comment has been given yet on the demands of the plaintiff.
