Power Morcellator Lawsuit Plaintiff Passes Away

November 12, 2015 – – Tracey & Fox reports on a tragedy from New Jersey, where a plaintiff who filed a lawsuit against power morcellator manufacturer Karl Storz has died. The lawsuit alleged that the power morcellator device used in her gynecological surgery caused her exacerbated diagnosis with uterine leiomyosarcoma. Complications from this rare form of cancer were the cause of her death.

The plaintiff was the proud mother of a 2 year old son, and just 43 years old when she passed away on September 5th of 2015. Prior to her death, the woman recorded her testimony which will be shown at a later date if her case proceeds to trial. She was diagnosed with advanced, stage 5 leiomyosarcoma just days after undergoing her laparoscopic power morcellation procedure.

In details within her lawsuit, the woman states that the spinning blades of the power morcellator tool shredded previously undiscovered cancerous tissue and spread it throughout her body, significantly advancing the disease and making it virtually incurable. Further, she claimed that had she not used a power morcellator, she would have likely caught her cancer at an earlier stage when it had spread less, and it may have been treatable.

This plaintiff is not the first woman to share this story. Across the United States many women have stepped forward filing lawsuits and similarly alleging that the power morcellator device used during their hysterectomies and myomectomies has spread previously hidden cancer cells. Additionally, she is not the first plaintiff to have died due to cancer after filing a power morcellator lawsuit.

Currently, a significant FDA warning has been made about power morcellators and their connection to the spreading of cancer. Additionally, the FDA has noted that approximately 1 in every 350 women undergoing laparoscopic power morcellation procedures may have undetected uterine cancers. For this reason, they no longer recommend that women use the device during hysterectomies and myomectomies.

The lawsuits concerning power morcellators have been consolidated to form multidistrict litigation number 2652. As they await trial, additional suits are expected to be filed.
