Power Morcellator Lawsuit Numbers Lead To Insurance Company Product Removal

November 16, 2015 – – Tracey & Fox reports on a recent move by Aetna insurance company to cease their coverage of power morcellator devices used during hysterectomy and myomectomy procedures. This decision follows numerous lawsuits which were filed against many of the manufacturers of the tool, as well as after a United States Food and Drug Administration warning linked the use of power morcellators during gynecological surgeries to the spreading of uterine sarcomas.

Aetna is the world’s third largest health insurance provider, so this decision is quite a large one. They stated that they have chosen to no longer cover power morcellator use for the removal of uterine fibroids in gynecological surgeries. Physicians could, they noted, discuss circumstances to obtain special clearance in order to use the tool in other procedures, which the insurance provider may or may not choose to cover.

Power morcellators are made by a number of different manufacturers, and have recently been the subject of many lawsuits as well as a recent FDA-issued warning which stated that most women were to refrain from having a gynecological procedure done with the tool, due to increasing reports of adverse events and recent study findings. It indicated that it may be possible for the tool to spread cancer during procedures like hysterectomies, oophorectomies, salpingectomies, and myomectomies.

Additional FDA statistics showed that an estimated 1 in each 350 women who undergo one of these gynecological surgeries may have previously undetected uterine sarcoma which can be disseminated by power morcellation. During power morcellation, the tool works much like a drill. It is inserted through a small incision in the abdomen. Once inside, tiny blades spin to tear apart troublesome tissue. Plaintiffs allege, however, that while the tool does this, it can also expose and spread cancer cells.

Mounting lawsuits have been consolidated to form multidistrict litigation 2652. This helps to enable litigation to run more smoothly. Additionally, it helps avoid different rulings from different judges, and avoids duplicate discovery.
