Power Morcellator Lawsuit Claims Device Caused Death Of Missouri Woman

November 16, 2015 – – Tracey & Fox reports on a lawsuit which was recently filed by the family of a woman who passed away alleging wrongful death against Ethicon, a subsidiary of Johnson & Johnson and manufacturer of the power morcellator used during her fibroid removal and hysterectomy. Details from within the complaint state that the Missouri woman underwent this surgery in December of 2012. The family alleges, however, then when this surgery occurred, the power morcellator not only tore apart her fibroid tissue as it was supposed to, but it also tore apart and uncovered tissue containing cancer cells, spreading those cancer cells through her body and effectively giving her a life sentence.

In August of 2014, less than 2 years after her gynecological surgery, the woman died due to metastatic uterine cancer. The family firmly believes that, had the cancer not been disseminated with the power morcellator device, the cancer would have remained encapsulated in a uterine fibroid and may have been much more treatable before it had the chance to spread.

Laparoscopic power morcellation has been the subject of many similar lawsuits recently. Plaintiffs uniformly agree that the device can spread cancer. The U.S. Food and Drug Administration has also stepped up to warn the public as well, stating that an estimated 1 in every 350 women undergoing gynecological surgeries to treat uterine fibroids may have previously undiagnosed uterine cancer. The FDA therefore stated that women should not use power morcellators in these circumstances due to the risk of spreading uterine sarcomas. According to the FDA, use of the tool could significantly impair a woman’s likelihood of long-term survival.

At this time, power morcellator lawsuits have been consolidated for form multidistrict litigation number 2652. This consolidation is designed to help the litigation concerning the power morcellators move more smoothly. It is said to help avoid duplicate discovery and differing rulings from multiple judges, and to also conserve resources of all involved. It is widely anticipated that as the the cases in the current MDL await trial, more will be filed.
