Power Morcellator Lawsuit Alleges Tool Spread Stage 4 Cancer

November 20, 2015 – – Tracey & Fox reports on another power morcellator lawsuit which alleges that the device, manufactured by Karl Storz Endovision, Inc., caused a woman from Michigan to be suddenly diagnosed with stage four cancer after a gynecological laparoscopic power morcellation surgery. The woman’s case, filed in the United States District Court for the Eastern Division of Michigan, is number 2:15-cv-10352-TGB-APP. The plaintiff is not alone in her claims and is joined by many similar lawsuits which have been filed across the county.

This particular plaintiff had to undergo a hysterectomy and bilateral salpingectomy in June 14th of 2011 in order to remove painful uterine fibroids that had developed. They gynecological surgery was completed with a laparoscopic power morcellator, and the woman was diagnosed post-surgery with stage 4 breast and bone cancer, which she continues to battle today. She alleges that the cancer was exposed and spread throughout her body by the power morcellator.

Power morcellator devices are placed into the abdomen through a small incision. Once inside, they spin small blades which work to shred apart troublesome uterine tissue and uterine fibroids. Allegations by plaintiffs across the nation, however, state that while the device shreds the tissue, it can uncover previously undetected cancer cells, and spread these exposed cells throughout the body. Plaintiffs state that this caused them to be diagnosed with a sudden high-grade, aggressive cancer which is difficult to treat, and significantly impaired their chances of survival.

On July 14th of 2014, the plaintiff in this particular case was admitted to the hospital to undergo spinal surgery. It was then that physicians discovered the cancer, and recommended extensive treatments due to its stage. The plaintiff indicates that she currently uses daily hormone drugs, medication injections, and multiple 10-week sessions of radiation therapy.

The U.S. Food and Drug Administration has released a safety warning regarding power morcellation as well. They have stated that most women should refrain from using laparoscopic power morcellation for gynecological surgeries involving uterine fibroids, due to the risk of spreading undiscovered cancer. They noted that 1 in every 350 women who undergo this process may have uterine sarcomas that they are not aware of.
