Zofran Birth Defect Lawsuits Surge In Boston As MDL Is Set To Begin
November 20, 2015 – – ZofranLegal.com reports on the growing number of families filing suit against anti-nausea drug Zofran and GlaxoSmithKline, looking to join the current multidistrict litigation in Boston. The lawsuits similarly allege that when taken by pregnant mothers, the drug can cause their babies to be born with birth defects. Defects most commonly alleged are cleft lip and palate, atrial septal defect and ventricular septal defect, transposition of the greater vessels, tetralogy of fallot, kidney defects, and clubfoot.
In addition to these allegations, there have been at least three major medical studies that have also identified a connection Zofran and birth defects. The families involved center much of their arguments around a single fact: GSK’s Zofran was never FDA-approved to treat expectant mothers for morning sickness. The drug was allegedly marketed and prescribed “off-label” for this use, to the likes of 1 million women in the nation annually.
Zofran was approved by the United States Food and Drug Administration to treat nausea and vomiting in patients who have just finished cancer treatment such as radiation or chemotherapy, or for patients who have undergone anesthesia for surgeries.
Those who have filed lawsuits have come together as the United States Judicial Panel on Multidistrict Litigation ordered that the Zofran birth defect cases be consolidated under one court. The MDL consolidation will help to expedite the legal process, avoiding duplicate discovery and saving resources for those involved.
As the MDL has been formed and the litigation process progresses, more have become aware of the alleged birth defect connection to Zofran, and additional families have filed suit. Records from the US District Court of Massachusetts show that on November 13th, 2015 alone, 30 Zofran birth defect lawsuits were filed.
