Zofran Birth Defect Lawsuits Continue To Pile Up Against GSK

November 22, 2015 – – ZofranLegal.com reports on the growing number of lawsuits filed against pharmaceutical giant GlaxoSmithKline which similarly allege that their anti-nausea drug Zofran has caused birth defects in children who have been exposed to it while developing in utero. The drug, approved by the U.S. Food and Drug Administration to treat people battling nausea from chemotherapy, radiation, and anesthesia, was prescribed “off-label” to an estimated 1 million pregnant mothers last year. Plaintiffs have called GSK’s marketing of the drug to this group of women, whom it was never tested for safety on, irresponsible and unacceptable.

One mother stated in Federal Court that this “off-label” practice was “experimenting with the lives of unsuspecting mothers-to-be and their babies,” with a “profit maximization” slogan for physicians.

Across the United States, as many women were prescribed Zofran to battle morning sickness during their first trimesters of pregnancy, they subsequently gave birth to infants with defects. According to allegations within their lawsuits, the most common birth defects noted are: cleft lip and palate, atrial septal defect and ventricular septal defect, transposition of the greater vessels, tetralogy of fallot, clubfoot, and kidney defects. The allegations state that many of these defects required multiple surgeries, left lasting effects, and sometimes proved fatal.

As the filing of these complaints continued to increase, the cases were consolidated to form multidistrict litigation in Boston, Massachusetts. This process is designed to assist the litigation process. It helps to avoid duplicate discovery and different judge rulings, and also helps to conserve the time and money of those involved. As the cases within the current MDL await trial, it is expected that others will continue to be filed.
